1. Acceptance of Terms

By accessing or using the services provided by Visbeyond Pvt. Ltd. ("Visbeyond", "we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

2. Description of Services

Visbeyond is a pure digital design studio specializing in digital design, cross-platform application development, user interface (UI) and user experience (UX) design, and related digital creative services. We operate on a subscription-based model. The specific scope of work, deliverables, and timelines are outlined within your active subscription tier.

3. Subscriptions and Payment Terms

• Billing Cycle: Subscription fees are billed on a recurring basis, corresponding to the exact date your plan initially started.

• Payment Methods: We accept all major credit/debit cards and supported digital payment methods.

• Grace Period: Clients are provided with a 4-day grace period following their billing date to complete the payment. Failure to remit payment within this 4-day window will result in the immediate cancellation of the entire service.

4. Cancellation and Refunds

• Refund Eligibility: A full refund is only applicable if the design work has not yet started.

• In-Progress Tasks: If a subscription plan is canceled while a specific task is currently in progress, all progress on that specific task will be permanently lost. This incomplete work will not be delivered and is not applicable for client review or approval.

• Non-Payment for Future Work: If a task is queued or added for the upcoming billing month but the renewal payment is not made, Visbeyond Pvt. Ltd. retains full rights to cancel the terms and services at any time. This policy is strictly enforced to ensure smooth operations and resource allocation within the company.

5. Intellectual Property Rights

• Client Ownership: Upon full payment of all applicable fees for a given billing cycle, Visbeyond grants you the rights to the final, delivered digital assets and design files as agreed upon in the project scope.

• Promotional Rights: Unless expressly agreed otherwise in writing, Visbeyond reserves the right to showcase the completed digital designs and applications in our portfolio, website, and promotional materials.

6. Client Responsibilities

To ensure the timely delivery of our digital design services, you agree to:

• Provide clear, concise, and timely feedback on design drafts and prototypes.

• Supply all necessary text, images, brand guidelines, or other assets required for the project.

• Guarantee that you own or have the rights to use any materials you provide to us, indemnifying Visbeyond against any third-party copyright claims.

7. Limitation of Liability

To the maximum extent permitted by Indian law, Visbeyond Pvt. Ltd. and its developers, designers, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from the use or inability to use our digital design services.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts located in Uttarakhand, India.
