These Terms of Use ("Terms") regulate your access to and use of the website www.visbeyond.com (the "Website") and the services provided by VisBeyond Pvt. Ltd. ("Company," "we," "us," or "our").
Our services include, but are not limited to:
Stride Tools: Custom workplace productivity automation and software.
Web Design: UI/UX design and development.
Video Production: Corporate and advertisement video creation.
Marketing: Digital marketing integrations and strategy.
By accessing our Website, purchasing our Services, or using our tools, you ("User" or "Client") agree to be bound by these Terms.
Service Engagement & Process
Quotes & Estimates: All quotes provided by the Company are valid for 30 days.
Project Initiation: A project is considered "Started" once the Service Agreement is signed or the initial payment is received.
Client Cooperation: The Client agrees to provide all necessary assets (logos, texts, feedbacks) in a timely manner.
Payment, Refunds, and Cancellations
Payment Terms:
Standard Projects: A minimum deposit of 50% is required before work begins. The remaining balance is due upon project completion and before final file delivery.
Stride Tools: Payment structures (One-time/Milestone) will be defined in the specific project proposal.
Cancellation & Refund Policy: Refunds are strictly limited to the following windows to cover resource allocation costs:
Scenario A (Partial Payment): If you have paid a 50% deposit and cancel the project within 2 days (48 hours) of payment, you are eligible for a refund of 20% of the deposited amount.
Scenario B (Full Payment): If you have paid 100% upfront and cancel the project within 2 days (48 hours) of payment, you are eligible for a 50% refund of the total amount.
After 48 Hours: No refunds will be issued for cancellations made after 2 days of payment, as resources and team members will have already been assigned to your project.
No Chargebacks: You agree not to issue a chargeback via your payment provider for services where these terms apply.
Intellectual Property (IP) Rights & Portfolio Usage
Ownership of Deliverables (Stride Tools, Web Designs, Videos):
Unlike standard licensing models, VisBeyond operates on a "Work made for Hire" basis for custom projects.
Upon full and final payment, the Client is granted 100% ownership rights to the final source code (for Stride Tools/Websites) and final video files created specifically for them. You own the code and assets tailored to your demand.
Portfolio & Showcase Rights:
Default Right: VisBeyond Pvt. Ltd. retains the perpetual right to display the completed work (e.g., website screenshots, video clips, software case studies) in our portfolio, social media, and marketing materials to demonstrate our capabilities.
White-Label / NDA Option: If the Client requires total privacy (meaning VisBeyond cannot showcase the work), this must be requested explicitly. A "White-Label Fee" will be applied to the project cost. This fee is variable and determined by VisBeyond based on the complexity, value, and nature of the project.
Payment of Fee: 100% exclusivity rights are transferred only upon payment of this additional fee.
Acceptable Use
You agree NOT to use our Website or Services to:
Upload viruses, malware, or malicious code.
Engage in any activity that violates Indian law or the laws of your jurisdiction.
Probe, scan, or test the vulnerability of our system without express written consent.
Warranties and Disclaimers
"As Is" Basis: Our Services are provided on an "as is" basis. We do not warrant that our software will be error-free or that marketing services will guarantee a specific monetary return (ROI).
Third-Party Tools: We integrate with third-party platforms (e.g., AWS, PayPal, Stripe). We are not responsible for downtimes or policy changes enacted by these providers.
Limitation of Liability
To the fullest extent permitted by law, VisBeyond Pvt. Ltd. shall not be liable for any indirect, incidental, special, or consequential damages. In no event shall our total liability exceed the amount paid by you to the Company for the specific Service in the six (6) months preceding the claim.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Any dispute arising out of or related to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts located in Haridwar, Uttarakhand, India.
Changes to This Privacy Policy
We may update our Terms & Conditions Policy from time to time. We will notify you of any changes by posting the new Terms & Conditions Policy on this page and updating the "Effective Date" at the top. You are advised to review this Terms & Conditions Policy periodically for any changes.
